Are Court Records Public in Williamson County?
Most court records maintained by the Williamson County Circuit Clerk are open to public inspection. Two Illinois statutes provide the primary legal framework for this access.
The Illinois Freedom of Information Act (5 ILCS 140) grants members of the public the right to access government records, including court documents. The Court Record and Document Accessibility Act (705 ILCS 86) specifically addresses public access to court records. Additionally, the Clerks of Courts Act (705 ILCS 105) requires circuit clerks to keep all records, dockets, and books open for public inspection.

Williamson County Criminal Court Records

Illinois State Police Background Checks
Under 20 ILCS 2630, the Illinois State Police (ISP) Bureau of Identification serves as the statewide repository for criminal history records. The public can obtain conviction records through the ISP using one of two methods:
- Name-based background checks — Conducted online through the CHIRP (Criminal History Information Response Process) portal. Users must register for a digital ID through the State of Illinois enrollment system. The maximum fee is $16.00 per search.
- Fingerprint-based background checks — Submitted electronically through a licensed live-scan vendor. A list of approved vendors is available through the Illinois Department of Financial and Professional Regulation. The maximum fee is $20.00 per search.

Williamson County Civil Court Records
Civil cases filed in Williamson County encompass contract disputes, personal injury litigation, property matters, small claims, foreclosures, and other non-criminal actions. The Circuit Court has general jurisdiction over all civil matters. Under the Williamson County fee ordinance, copy fees for court documents start at $2.00 for the first page, $0.50 per page for the next 19 pages, and $0.25 for each additional page. Certification of copies carries an additional fee.
Civil Process Through the Sheriff’s Office
Civil process papers in Williamson County — including summonses, subpoenas, writs of execution, and eviction orders — are served by the Sheriff’s Office. Williamson County Family Court Records
Family law cases in Williamson County — including dissolution of marriage (divorce), child custody, child support, orders of protection, adoption, and guardianship proceedings — are adjudicated by the Circuit Court. The Circuit Clerk maintains all family case filings, orders, and judgments.
Divorce Records
Divorce decrees and related filings are maintained by the Williamson County Circuit Clerk’s Office. Interested parties can request divorce records by visiting the Clerk’s Office in person or submitting a written request. Basic case information for recent divorces may be searchable through Judici.
The Illinois Department of Public Health (IDPH) provides marriage dissolution verification for events from 1962 to the present. Verification includes the names of the parties, dates of birth, date of dissolution, and the county where it took place. The verification fee is $5.00.
Marriage Records
The Williamson County Clerk and Recorder’s Office maintains marriage records for licenses issued and ceremonies performed in the county. Marriage licenses must be obtained in the county where the ceremony will take place. Both parties must be at least 18 years old to marry without parental consent in Illinois; applicants aged 16–17 require signed parental consent at the County Clerk’s Office.

Birth and Death Records
The Williamson County Clerk and Recorder’s Office issues certified copies of birth certificates and death certificates for events that occurred in the county. Requests require a completed vital records request form along with a valid photo ID.

Williamson County Probate Court Records
Probate matters in Williamson County are handled by the Circuit Court. These proceedings include will validation, estate administration, appointment of executors and administrators, guardianship of minors and incapacitated adults, conservatorships, and resolution of disputes among heirs or creditors.
