How to Look Up a Court Case in Kendall County?

It is important to note that the Illinois Supreme Court Electronic Access Policy limits which documents can be viewed online. While docket entries and case summary information are generally available, certain documents require an in-person visit. The Circuit Clerk Viewing Room at the courthouse is open for document inspection from 8:30 a.m. to 4:30 p.m., Monday through Friday, excluding court holidays.
In-person requests
The Circuit Clerk’s Office accepts walk-in record requests during business hours. Requesters should bring as much identifying information as possible, including party names, case numbers, and approximate dates. A valid government-issued ID may be required for certain records.

The Circuit Clerk’s Office offers eNotify, a free service that sends text message or email reminders of upcoming court dates. Users can sign up for notifications on a per-case-number basis.
Fees and payment
Filing fees for the Kendall County Circuit Court are established by 705 ILCS 105/27.1a. Fees are payable in advance by cash, money order, cashier’s check, or personal check. Credit card payments are not accepted at this time. ACH payments are now available for those who file the required ACH form with a voided check. The statutory fee for correction of a case number, case title, or attorney registration number on any document is $25.00 per document.
Persons unable to pay filing fees may request a fee waiver. The Circuit Clerk’s Office posts a notice in English and Spanish under Public Act 91-621 (735 ILCS 5/5-105) advising that individuals who cannot afford fees may apply to the court to proceed without paying them. An Application for Fee Waiver is available at the clerk’s office.
Are Court Records Public in Kendall County?
Court records in Kendall County are generally public under the Illinois Freedom of Information Act (FOIA), 5 ILCS 140. This law declares it the public policy of Illinois that all persons are entitled to full and complete information regarding the affairs of government, and it grants the public the right to access, inspect, and copy records maintained by governmental bodies, including the courts.
However, FOIA also establishes exemptions under Section 7 (5 ILCS 140/7) where records or portions of records may be withheld. In the context of court records, the following categories are commonly restricted or subject to limited access:
- Juvenile records — Proceedings involving minors are generally confidential under the Illinois Juvenile Court Act.
- Sealed and expunged records — Criminal records that have been sealed or expunged by court order are removed from public access.
- Records involving sexual assault victims — Identifying information about victims may be redacted or restricted.
- Mental health records — Court filings involving mental health proceedings carry confidentiality protections.
- Adoption records — Adoption proceedings are confidential under Illinois law.

The Illinois Supreme Court Electronic Access Policy further governs what court documents are available online versus at the courthouse. Some filings viewable in the clerk’s office will not appear in the online records system due to these restrictions.
Kendall County Criminal Court Records
The Kendall County Circuit Court has general jurisdiction over all criminal matters in the county, including felonies, misdemeanors, DUI offenses, drug offenses, sex offenses, traffic violations, and conservation offenses. Criminal assessments are imposed in accordance with the Criminal and Traffic Assessment Act (705 ILCS 135/1-1 et seq.) and follow detailed schedules established by county ordinance.

Sheriff’s Office records
The Kendall County Sheriff’s Office Records Division maintains police reports, citations, warrants, and expungement records. Kendall County Civil Court Records
The Kendall County Circuit Court handles all civil matters, including contract disputes, personal injury claims, real estate litigation, and small claims. Civil cases must now be filed electronically through eFileIL in accordance with Illinois Supreme Court rules. The proper fees must accompany all electronic filings.

Key procedural requirements for civil filings and record requests in Kendall County include:
- All documents must be filed on 8½ × 11 paper, following the local rule on standard format.
- Civil cases that are filed receive an automatic 90-day status return date assigned by the Circuit Clerk (per Kendall County Administrative Local Rule 87-6).
- Depositions, interrogatories, answers to interrogatories, and other discovery documents are not accepted for filing. Proof of service and notice of filing are required.
- Multiple case numbers may not appear on a single original document; a separate original is required for each case number.
- Documents should not be stapled, as the office scans all filings.
- Documents are not accepted by fax or email.
- Original documents must be filed at least three days prior to any scheduled court date in order to be heard (per Kendall County Administrative Order 01-01).

Property records
Property-related records—including deeds, mortgages, liens, and plats—are maintained by the Kendall County Recorder at 111 West Fox Street (now updated to 502 South Main Street for the Clerk/Recorder functions), Yorkville. Kendall County Family Court Records
Family law matters in Kendall County are adjudicated by the Circuit Court, which handles divorce, child custody, child support, spousal support, paternity, property allocation, adoption, Orders of Protection, and related proceedings.
Accessing family court records
Family case information can be searched online through the Online Court Records platform. However, some family law documents—particularly those involving minors, domestic violence, or adoptions—may be restricted under the Illinois Supreme Court Electronic Access Policy and state confidentiality statutes. For such records, an in-person request at the Circuit Clerk’s Office may be necessary.

Vital records
The Kendall County Clerk’s Office maintains birth, death, and marriage certificates for events that occurred in the county. Certified copies may be ordered online or in person. Current fees for online orders are:

Online orders carry an additional non-refundable $5.25 service and credit card processing fee. Standard shipping through USPS is free (allow 7–10 business days after approval); priority shipping is $12.90. Birth certificates are available for births in Kendall County from 1877 to present. Marriage records date from 1841 to present. Death records are available from 1877 to present.
Persons born outside Kendall County must contact the county where the birth occurred. Because Kendall County does not have a hospital, births at Rush Copley Medical Center should be directed to Kane County.
Kendall County Probate Court Records
Probate matters in Kendall County are handled by the probate division of the Circuit Court. The court exercises jurisdiction over estate administration, wills, guardianship of minors and incapacitated adults, conservatorship, adoption, change of name, and trust-related proceedings. Probate cases are heard in Courtroom 116 of the Kendall County Courthouse.
Filing a new probate case
The Circuit Clerk’s Office provides downloadable forms for opening probate cases. For estates of deceased persons, the required initial forms include a New Case Probate Information Sheet, the applicable petition (Petition for Admission of Will, Petition for Letters Testamentary, or Petition for Letters of Administration if no will exists), an Affidavit of Heirship, Oath of Representative, Bond, and the appropriate court order. A copy of the will must be filed if one exists.
For guardianship of a minor, required forms include a New Case Probate Information Sheet, Petition for Guardian, Oath of Representative, and Bond. Additional forms that may be needed during case proceedings—such as inventories, annual reports, annual accountings, motions, and orders—are also available on the clerk’s website.
All probate filings must include an email address on the appearance form. Under Kendall County Administrative Local Rule 87-6, probate cases receive an automatic 9-month status return date.
